Police Admit Sexual Deception

LEGAL papers yesterday revealed that police have admitted that the managers of an undercover officer knew that he was having a long-term sexual relationship with a woman who he deceived.  This is the first admission by senior police officers that undercover done this.  Hitherto, the top brass had claimed that undercover officers were not allowed to have sexual relationships with campaigners they were spying on under any circumstances.

 This admission admission was made by police in a legal case launched by Kate Wilson, an environmental and social justice activist who was deceived into a two-year intimate relationship by the undercover officer Mark Kennedy.

This is the first case to be heard by the Investigatory Powers Tribunal (IPT) from a woman who had a sexual relationship with a police spy who concealed his true identity from her.

Wilson is one of a dozen women who have successfully sued police in high court case.

After a lengthy legal battle in the high court, the Met has been forced to pay compensation to the women, although it successfully avoided handing over any internal documents about the relationships.

After leaving the Yard he was appointed Counter-Terrorism Adviser to the Foreign Office, where he worked with government and intelligence experts worldwide in the campaign against Al Qaeda.

What happened to the undercover police inquiry?

TWO years into the public inquiry into undercover policing and campaigners spied upon by the state this week claimed that progress has stalled and no information had been revealed about the officers involved. Jon Robins reports:

Speaking at an event at the Labour fringe on undercover policing and police surveillance, core participants in the undercover policing inquiry together with  their lawyers accused the government of delay and expressed concerns about the new chair of the inquiry.
Helen Steel is one of eight women activists who began legal action against the police having discovered that former long-term partners had been undercover policemen. Steel, who was representing the Police Spies out of Lives group, told delegates they were as much in the dark as the day that the inquiry was launched in July 2015. ‘More than two years into the inquiry and we still have had no disclosure about the relationships or the officers involved. The public has learnt absolutely nothing new about the extent of police in the abuse or how this was allowed to happen,’ she said.
In May this year, Sir John Mitting took over the chairmanship of the inquiry from Lord Justice Pitchford, who had been diagnosed with motor neurone disease. The inquiry has long become bogged down as the police have called for proceedings to be held in secret to protect the identities of the undercover officers – as reported on the Justice Gap (here).
‘The inquiry has finally acknowledged upwards of a thousand groups were spied upon but still hasn’t released the names of those groups,’ Steel told the meeting organised by the Haldane Society of Socialist Lawyers. Steel argued that whilst the police were prepared to confirm that they sent undercover officers into Isis, ‘they claimed it would be too dangerous to confirm the names of the thousand campaigns spied upon by the Special Demonstration Squad and the National Public Order Intelligence Unit,’ she said. ‘It beggars belief.’
In a message to the meeting Michael Mansfield QC, the president of the Haldane Society, claimed to be ‘under no illusions as to the extent to which agencies in the state have taken an interest in me’ in relation to his work on political cases such as Orgreave, Hillsborough and the Shrewsbury pickets.

Judge in Undercover Policing Inquiry to Quit


THE Judge, Sir Christopher Pitchford, involved in the Pitchford Inquiry into undercover policing used to infiltrate trade unions and left-wing groups in England since the 1960s, has revealed that he has been diagnosed with motor neurone disease.
This means he will eventually have to stand down from the complex and already-delayed probe.
It is said that this has not yet affected his running of the inquiry so far - although the judge's physical symptoms have been becoming apparent.
The home secretary has been asked to appoint another judge to work alongside Sir Christopher and succeed him when he ultimately stands down.
The inquiry is already well behind schedule because of a complex legal dispute with Scotland Yard over how many former officers from the controversial unit at the heart of some of the allegations ought to give evidence.
This fall-out is expected to come to a head in a public hearing later in the spring which is expected to still take place with Sir Christopher at the helm.

Pitchford uncovers undercover police!


THE Pitchford public inquiry into undercover policing has today issued a very short press release that admits that 'Carlo Neri' was an undercover officer. The 'Update on anonymity applications' reads:  The Inquiry has received confirmation that no restriction is sought over the undercover identity used by the police officer core participant known as N104, which was 'Carlo Neri'
The Blacklist Support Group, has been granted core participant status in the Pitchford inquiry issued the following statement: 
'Carlo Neri spied on blacklisted trade union members and anti-racist campaigners, while at the same time having long term sexual relationships with female activists he was keeping under surveillance. There are serious concerns about his conduct while undercover including allegations that he acted as an agent provocateur, inciting anti-fascist activists to commit an arson attack on a charity shop which was run by the Italian fascist Roberto Fiore.  
Neri was only exposed after collective efforts of activists ourselves working along side investigative journalists and researchers. Both Newsnight and The Guardian ran the original story. Photographic evidence from 2005 of Neri spying on an RMT picketline in Kings Cross were published in the "Blacklisted" book published last month.  
'The public statement by the Pitchford inquiry is a vindication of our campaign for justice but this admission has been dragged out of the police who have repeatedly adopted the line that they can 'neither confirm nor deny' (NCND) whether individuals named by activists in the media were police officers. The same NCND tactic used to obstruct the truth is also being applied to the hundreds of campaign groups targeted by the Special Demonstration Squad. While now being forced into admitting that 'Carlo Neri' was a police officer, the Met Police is still refusing to provide relevant police files to those that he targeted.   
'Now is the time for the Met Police to come clean and release the cover names of all the spycops and a list of the campaigns that were infiltrated by these undemocratic political policing units. The continued obstruction by the Met Police endangers the very integrity of the public inquiry. The police are supposed to be accountable to society: Its now reaching the point where parliament needs to step in and get a grip of these anti-democratic forces.'
'Andrea' (not her real name) is part of the Police Spies out of Lives campaign and is currently suing the Metropolitan Police for the emotional abuse caused by the activities of Carlo Neri.  During his deployment, the married undercover officer lived with and proposed marriage to the female activist he was targeting.  'Andrea' reacted to the Pitchford announcement:
'I am of course relieved to have finally received official confirmation that the person I believed to be my partner of more than two years - Carlo Neri - was in reality an undercover police officer. The fact that it has taken the police so long to acknowledge this has undoubtedly caused additional stress and uncertainty within an already difficult situation for myself and my family. MPS initially refused to comment on my complaint, stating that the UCPI would deal with my allegations, but have subsequently stated that they will not contest liability. My case is now in process. MPS do however continue with their inexplicable 'neither confirm nor deny' policy. This is quite simply a strategy to obfuscate, deny access to the truth and it has to stop. As survivors of their abuse, we demand that ALL spycops cover names are released.'
Kate Ellis, from Imran Khan and Partners, the solicitors representing the blacklisted trade union members and anti-racist campaigners targeted by Carlo Neri issued the following statement:
'We welcome the Inquiry’s confirmation of an undercover police officer’s cover name. This shows to our clients in fact how essential it was for there to be a Public Inquiry. To date, the Metropolitan Police’s ‘Operation Herne’ investigation has continued to maintain the absurd position of ‘neither confirming nor denying’ that Carlo Neri was an undercover police officer – despite the fact that everyone else knows and accepts that he was.   
'The Inquiry’s transparency in confirming undercover officers’ identities should not only be welcomed; it should be the default position. The stark difference in approach between the Metropolitan Police and the Inquiry shows that there is an even greater need for the police to open up their files for scrutiny.'

Did Carlo Neri Spy on Trade Unionists?

Blacklist Group Claim to have caught undercover copper on camera!
'UNDERCOVER police officer Carlo Neri', according to the Blacklist Support Group, was caught on camera and 'spied on the RMT union'.  Photographic evidence, the Blacklist Group claim, shows that in October 2004 an officer was present at the industrial dispute following the sacking of the prominent union militant Steve Hedley (now elected as Senior Assistant General Secretary of the RMT union) during construction of the Kings Cross terminal for the Channel Tunnel Rail Link.  
If this report is true, and it was indeed Carlo Neri captured on camera by the freelance photographer Andrew Wiard at the RMT picket and just assuming he was not supporting the industrial protest, but was indeed employed as a police spy (allegedly from the Met's disgraced Special Demonstration Squad), then it is yet further evidence of penetration by the police and security services into the trade union affairs of English activists.
The photographs sent to Northern Voices by the Blacklist Support Group show the alleged 'police spy' lurking behind an RMT banner with the slogan ‘Reinstate Steve Hedley’ while handing out leaflets to construction workers who had walked out in support of the victimised union activist.  Also present at the picket line were RMT activists Alex Gordon and Sarah Friday plus GMB construction organisers Kelly Rogers and Steve Kelly (who was subsequently banned from the project controlled by the blacklist companies Costain, O'Rourke and Emcor).

Steve Hedley commented:    'I am appalled that a secret police spy thought that it was justified to turn up on a peaceful RMT picket line in order to gather information. I had earlier housed this person rent free as he claimed he was being made homeless and feel shocked that taxpayers money could be used like this to betray the trust of people engaged in completely legitimate industrial action.  We heard a lot growing up about police states in other countries whilst it turns out  our state was doing exactly the same thing here.' 
The photographs were rediscovered by Dave Smith while researching for the updated version of the book Blacklisted and were first made public at the GMB conference in Bournemouth on Sunday evening (5th June). Smith commented afterwards:  'We were standing up for workers rights but apparently the British state considered us such a threat, that we were kept under constant surveillance by shady anti-democratic units in the police. This is nothing less than political policing and has no place in a democracy.  This took place during the Tony Blair government and I want to know why trade unions were were being spied on under a Labour Home Secretary. David Blunkett has serious questions to answer.' 
The Channel Tunnel Rail Link dispute is recorded on Consulting Association blacklist files of Steve Hedley and GMB organiser at the time, Steve Kelly. 
Both Steve Hedley and Dave Smith have been granted core participant status in the Pitchford public inquiry into undercover policing.

LAST November, Northern Voices was one of several publications to receive a solicitor letter from a firm of solicitors that  has been known to do work for the Police Federation.  The allegation was that NV had defamed a former police officer who had more recently done work as a university lecturer.  It seems that the officer in 2008 had given a power-point presentation on policing at pub down South to a group of individuals, who it later turn out were affiliated to the Consulting Association.  Ian Kerr was among those present taking notes:  Mr. Kerr, who has since died, is famous as the administrator of a blacklist for the Consulting Association, and he later pleaded guilt to running an illegal data base.  Kerr was exposed as such by the Information Commissioner in 2009.  We therefore caution our readers because the officer who gave this power point presentation to the Consulting Association has since claimed that he didn't know that he was addressing the Consulting Association, and that he'd never heard of either Ian Kerr or the body now known to be the Consulting Association.  He was just filling in for a colleague we are told, and is innocent of any complicity with the Consulting Association, Ian Kerr or blacklisting in the British build trade.  We only mention this now, in case it later turns out that Carlo Neri, if that is what he is called, was just out for a stroll and accidentally got caught up in the trade union protest of the RMT.

Title: Scotland, Pitchford and Undercover Policing
That the Parliament believes that a growing number of Scottish citizens have been identified as being involved in undercover policing scandals involving the National Public Order Intelligence Unit and the Special Demonstration Squad of the Metropolitan Police, either as victims or as officers working on cases; considers that these units operated in Scotland keeping political, environmental, trade union and other activists under surveillance using unethical and often illegal methods; understands that the Pitchford inquiry, established by the Home Secretary, Theresa May, to look into undercover policing since the 1960s, does not cover Scotland in its remit; further understands that the Scottish Government has written to the UK Government asking for the inquiry to be extended to cover Scotland, and notes the view that, should this request be refused, the Scottish Government should set up its own inquiry so that all UK citizens, including those in Lothian who have been affected by what it considers this scandal can have the opportunity to get to the truth.

High Court blacklisting litigation saw a 2 day hearing on Mon-Tues last week (7-8 Dec), with an additional evening session on Tuesday.  As the blacklisting firms have already admitted their guilt to the court, the entire 2 days was taken up with legal argument over the use of expert witnesses for calculating loss of earnings.

John Hendy QC told the court that the estimated total damages for the 600 claimants is in the region of £60-70million, made up of £40m in loss of earnings and £20-30m in general damages (defamation, human rights, hurt to feelings etc..).  Lawyers on behalf of blacklisted workers had applied to use the expertise of Dr Victoria Wass from Cardiff Business School, one of the leading labour market economists in the UK who has acted as an expert witness in numerous high profile cases in the past. 

The firms argued against the use of Dr. Wass, arguing that the 'regression analysis' that she was using was 'too complicated' and could not be fully understood by the court (even though virtually every university student in the world is taught regression analysis as a standard statistical tool nowadays).  Dr Wass is able to provide a high level of precision in her estimates of loss because she has restricted access to micro data from the Office of National Statistics labour market database. Without an ounce of irony, lawyers for the blacklisting companies, told the court that having access to the ONS personal sensitive information could potentially be a breach of human rights and data protection!  

In the end, Lord Supperstone and Master Leslie refused the claimants submission - once again, judges make findings in favour of big business and against the interests of blacklisted workers.  This may be a minor setback in a small skirmish but we are still going to win the war.  

The next provisional hearing date is 1st February 2016.  Full trial is set to start in May 2016 and will last 10 weeks.

2. John McDonnell, Shadow Chancellor was the keynote speaker at a packed Blacklist Support Group parliamentary meeting in Westminster on Monday 7th.  McDonnell raised a number of issues during his speech which will have major impact even before the election of a Corbyn government.  A few of John McDonnell's quotes from the meeting: 
'Blacklisting was a deliberate attempt to undermine trade unions by victimising a layer of activists they could not buy off Tony Benn, Jeremy Corbyn and myself put in amendments to legislation on the issue of blacklisting over a period of decades - no government took any notice.  We are currently drawing up advice for Labour councils over public procurement regarding blacklisting, human rights and environmental issues.  Company directors who orchestrated blacklisting conspiracy should have been sent to prison. Blacklisting should be made a criminal offence.  If we can have the Leveson inquiry into celebrities phones being hacked, then why can't there be a pubic inquiry into blacklisting?' 

These remarks could have immense significance for companies involved in blacklisting.  

John McDonnell was a founder member of the Blacklist Support Group who has stood with blacklisted workers on picket lines, in parliament and at our meetings ever since. We stand shoulder to shoulder with him against all the attacks from the mainstream media and are proud to call him a comrade.  

Also in attendance at the BSG meeting was Sir Bill Morris and speakers including Chris Stephens MP and blacklisted activist Helen Steel.  

The BSG parliamentary meeting voted unanimously that the apology given to the women activists by the Met Police should be used as a template for any future apology that blacklisted workers should expect from the blacklisting construction firms and that a representative of the BSG should be present at any ongoing talks where such matters are being discussed. 

3. Scotland 
Another speaker at the BSG parliamentary meeting was Chris Stephens MP for Glasgow South West (SNP trade union coordinator at Westminster). Stephens was questioned by many in the audience including UNITE EC member Frank Morris, over why blacklisting firms were still being awarded public contracts such as Dundee Riverside and ScotRail in Scotland, despite a Scottish government procurement note on the issue. Stephens gave positive assurances that behind the scenes, this were moving in the right direction and asked the audience to wait for a Scottish government announcement very soon. 

There have also been massive developments in Scotland over the past few weeks regarding the role of undercover police spying on trade unions and social justice activists.  The Pitchford inquiry into undercover policing has a strict remit which only allows investigation into the activities of the political policing units in England and Wales.  But following a UNITE the Union, meeting in the Scottish parliament 3 weeks ago, there have been a number of articles in the Scottish press calling for an inquiry into the role of the undercover police in Scotland. 

Blacklisted environmental activist Helen Steel was another speaker at the BSG meeting and she told how she was spied on by the undercover police officer John Dines when a member of London Greenpeace during the McLibel trial in the 1980s and how she had visited Scotland with the police spy.  Steel also called for the activities of the undercover police in Scotland to be fully investigated by Pitchford. 

Chris Stephens MP told the BSG meeting that he fully supported the call by BSG, Campaign Opposing Police Surveillance (COPS) for there to be a public inquiry into the activities of undercover police in Scotland. 

4. Shrewsbury Pickets 
Previously undisclosed documents have been discovered proving that the former Conservative Prime Minister Ted Heath directly intervened in the Shrewsbury trial by supporting the role of the secret services in a hostile TV documentary be shown the night before the trial. 'This is the real conspiracy' as Des warren famously said from the dock on the day he was sent to prison.  The Shandow Home Secretary Andy Burnham raised the issue in parliament and demanded the release of all the undisclosed government documents relating to the Shrewsbury Pickets trial.  Great research work by Eileen Turnbull on behalf of the Shrewsbury 24.  The government still refuse to publish the papers: 42 years after the miscarriage of justice.    


5. Carillion 
Carillion have dropped their claim for £3500 worth of legal costs against blacklisted engineer Dave Smith - great investigative journalism by Mark Metcalf who knew before we did! Despite an apology to the High Court, Carillion continue to bad mouth Smith on their corporate website viewed by millions globally. Some apology! 

6. MUA 
Dave Smith report: 'It was my honour to represent the Blacklist Support Group at the inaugural conference of the Maritime Union of Australia Queensland in Brisbane, Australia. Many BSG supporters will remember Bob Carnegie​ who toured the UK this summer, who has just been elected as MUA secretary in Queensland and made the very generous offer.  The MUA are one of the most leftwing unions, alongside CFMEU and ETU provide the blue collar militancy that Australian unions are famous for worldwide. Activists from the ITF and the rank & file IDC were present and told stories of solidarity, heroism against police racism and internationalism.  I spoke about blacklisting, safety and had the privilege to join Brisbane River Ferry workers on protected industrial action.  I also met the crew of Fijian seafarers who had been knocked for wages who were occupying a ship who face being deported and a detention centre for standing up for their rights.  Solidarity to Bob Carnegie and all the comrades at MUA.'
