Public inquiry says Mark Cassidy was police spy

THE undercover policing public inquiry has finally confirmed that the joiner many of us knew as Mark Cassidy was in truth an undercover police officer.  His real name is Mark Jenner and 
between 1995-2000, he infiltrated the construction UCATT (his subs were paid from a bank account set up by Special Branch) 

He also infiltrated rank and file groups including the Building Worker Safety Campaign, the meetings of which he chaired at the Colin Roach Centre in Hackney. Jenner / Cassidy also targeted RMT, Unison, CPSA, TGWU and was on numerous picketlines including Dahl Jenson at Waterloo, JJ Fastfoods at Tottenham Hale and L.B. Southwark DLO.

Mark Cassidy / Jenner was first publicly named in by an article by journalist & union activist Mark Metcalf and in Blacklisted book by Phil Chamberlain & Dave Smith.  The Met Police issued a public apology to 'Alison', the activist he lived with during the five years of his deployment. It is shameful that the Met and the public inquiry have taken so long to admit that Mark Cassidy was an undercover police officer from the Special Demonstration Squad, something that everyone has known for years.  

'Alison', Mark Metcalf, UCATT (now part of UNITE) and blacklisted workers Brian Higgins, John Jones, Steve Hedley, Frank Smith, Dan Gilman & Dave Smith (who attended meetings, protests and pickets with Mark Cassidy / Jenner) have all been granted core participant status in the undercover police public inquiry. 

This public confirmation about Mark Cassidy comes just a week after the Met confirmed that police provided information to the building industry blacklist.

Blacklist Pre-Trial Review

1. Blacklisting High Court latest figures:
Over 180 blacklisted workers settled their claims after renewed offers from the firms in the past 2-3 weeks. The estimated cost to the firms for these cases alone is in the region of £15-20million plus legal costs (which could be considerably more).
There are 154 live claims remaining (across all legal teams) plus 82 recently issued new claims. 
The next hearing is a Pre-Trial Review on 21st April. The full trial starts on 9th May and is scheduled to run until 31st July.
2. Corporate Criminals 
Blacklist Support Group teamed up with the 'BP or not BP?' campaign to host a rebel exhibition inside the British Museum last weekend to highlight the unethical relationship of cultural institutions and corporate criminals. One exhibit was a Hart Hat artwork by BSG Artist in Residence, which has now been donated to the official collection under the Museums Act.

Blacklisting Cost of Disclosure


1. HIGH Court orders blacklist firms to disclose further evidence and issues costs of £100k against them.

Last Friday (22 Jan), the High Court made judgements against blacklisting firms; Balfour Beatty, Carillion, Costain, Kier, Laing O’Rourke, Sir Robert McAlpine, Skanska UK and Vinci PLC ordering them to disclose further evidence from back up computer tapes of emails that despite previous court orders, they had failed to provide. 

The 2 day hearing before Lord Justice Supperstone and Master Leslie, heard revelation after revelation about the extent of destruction of documents by the firms relating to their involvement with the Consulting Association blacklisting body. The final decision of the hearing resulted in costs being awarded against the companies to cover the full 2 day hearing, estimated to be in excess of £100,000. 

Dinah Rose QC, representing the 600 blacklisted workers in the litigation told the court that household names such as "Sir Robert McAlpine Ltd, Balfour Beatty and Carillion had destroyed the lives of thousands of working men and women" and that their continued conduct was designed to "cover their tracks". 

The role of Cullum McAlpine, director of Sir Robert McAlpine Ltd (SRM) and founding Chairman of the Consulting Association blacklisting body came in for particular criticism. Despite a court order requiring full disclosure, not a single email or document to or from Cullum McAlpine, his personal assistant or from David Cochrane final chairman of TCA have been disclosed. The court was even told how in 2011 all hard copies of correspondence between Cullum McAlpine and the Consulting Association had been destroyed. Dinah Rose QC told the court that "Sir Robert McAlpine Ltd has been evasive with conduct intended to conceal the central role of Cullum McAlpine. Cullum McAlpine is a very important man, for the sake of retaining trust in the British legal system, he must not allowed to get away with a cover up."

The court was also shown evidence that David Cochrane (SRM) chairman of the Consulting Association at the time of its discovery had contacted the blacklisting organisation's cheif executive Ian Kerr instructing him to "ring everyone - destroy all the data". It was revealed that Cochrane had told Kerr to keep Cullum McAlpine's name out of the press and large sus of money were transferred to the bank account of Ian Kerr's daughters in the summer of 2009.   

Balfour Beatty were also highlighted when it was revealed that despite instructions to the contrary, the PC and laptop of Elaine Gallagher, main contact for the company with TCA had both been wiped in April 2013. Trevor Watcham from balfour baetty was chairman of the Consulting Association from 2004-5 but his entire email history was deleted in 2011 and not a single document from him has been disclosed. It was also disclosed to the court that an internal Balfour Beatty database containing the names of construction workers who had been involved in union activities had been discovered on the laptop of Gerry Harvey, director of Human Resources, still employed by the company at their Glasgow head office. The comments "not required" and "do not re-employ" appeared next to the names of the union members and the document was found after the discovery of the Consulting Association blacklist was exposed in March 2009.  Lord Justice Supperstone commented "If the firms were professional enough to cover up their actions, did they also cover up more internal databases?"

Edmund Nourse QC representing the McFarlanes defendants said that "no impropriety whatsoever" could be implied over the destruction of the documents, which were merely "unfortunate mistakes".

Dinah Rose described the McFarlanes position on non disclosure and destruction of evidence as "bonkers" and described an expert witness statement provided by the firms as "disgraceful and intended to mislead". 

Dave Smith from the Blacklist Support Group commented afterwards:
"All of the platitudes and half apologies, all their crocodile tears and claims of rogue managers from the companies over the past six or seven years are clearly nonsense. Documents have been destroyed and Directors of multinational companies are hiding stuff on their laptops. It calls into question all of the promises made to Parliament and the High Court. I am not a lawyer but I would have thought that destroying evidence that would almost certainly have been used in a court case might be considered perverting the course of justice.

The lawyers seemed particularly keen to keep any evidence about Cullum McAlpine being disclosed -  this wretch set up and was the funding chairman of the Consulting association. He was intimately involved in its operation over many years. What could he possibly have to hide?”

2. Undercover police targeting activists
More revelations have come out this week about undercover police spying on activists in court admissions by the Met Police and press articles exposing newly discovered spycops who targeted trade unions, grieving families of murder victims, community justice campaigns, environmental activists, socialist political parties and animal rights groups. The Pitchford public inquiry into undercover policing has been set up to investigate the abuses carried out by these secret police political spying units. All of the information that has so far been discovered is due to activists, dedicated researchers and investigative journalists. The police continue to use the strategy of 'Neither Confirm Nor Deny' as a way of thwarting the truth. The Blacklist Support Group working alongside other core participants and the Campaign Opposing Police Surveillance (COPS) is calling for Lord Justice Pitchford to demand that the police release the cover names of all the undercover officers who have operated since 1968. Only then, will we know the full extent of the peaceful campaigns infiltrated and undemocractic practices carried out by the secret state.

4. Dave Smith's magistrates court case has been POSTPONED - and will not now be taking place this week. He has now been on police bail for nearly 12 months since his arrest for protesting about blacklisting on the Crossrail project.

5th Feb - Trumbo - film about the Hollywood blacklist during the McCarthy era starring Brian Cranston (Breaking Bad) is released in UK cinemas. This is a great opportunity for supporters locally to write to local newspapers saying that blacklisting is not something that only happened 50-60 years ago in the USA. Its still going on today in the UK.

High Court & Blacklist Book etc.

1. High Court:
The end of January is the deadline for the firms to disclose any documents they hold relating to The Consulting Association or Economic League blacklisting organisations. To date they have not disclosed a single set of minutes or any other document - we await to see what the firms claim to hold. The next date for the Blacklisting group litigation at the High Court has been set for Friday 13th February.

2. Dave Williams R.I.P.
Blacklisted bricklayer Dave Williams has recent passed away. He was a UCATT shop steward and member of the Laing's Lock Out Committee who were served with a High Court injunction during their struggle against blacklisting in 1985-6. Attached is an obituary by Brian Higgins who worked with Dave during the 1980s.

The Blacklist Support Group are planning a UK wide tour with the authors Dave Smith & Phil Chamberlain during March-April. The aim is to publicise the issue during the General Election campaign. BSG are asking all supporters to try an arrange a meeting local to where you live - contact your University, Trades Council, bookshop, union committee etc.. to see if they would like to host an event - please contact BSG to confirm dates & arrange the logistics. We are also looking for media opportunities.

BLACKLISTED BOOK PUT ON HOLD!

Phil Chamberlain and Dave Smith issued the following statement:

'We regret to announce that our contract with Pluto Press to publish the book: Blacklisted: The secret war between big business and union activists, has been terminated by mutual agreement with no ongoing liabilities remaining on either side.

Six years of investigative journalism has produced a finished manuscript that names and shames those who orchestrated and colluded with the blacklisting human rights scandal. 

We are currently looking at a number publishing options and are 100% confident that Blacklisted will be published before next year's general election.'

The co-authors also sent the following tweet via the Twitter account @blacklistedbook:
'Regretfully, contract with Pluto for "Blacklisted" ended by mutual consent.  Options being considered to ensure publication before Gen Election.'

Met. Police Refuse to confirm or deny spying

CAMPAIGNERS against the construction industry blacklist have reacted with anger after the Metropolitan Police (MPS) refused to 'neither confirm no deny' (NCND) whether the Blacklist Support Group is under surveillance by undercover police units including Special Branch. The statement from the MPS came in a response to a Freedom of Information request on 9th October 2014 sent to investigative journalist Phil Chamberlain. The Metropolitan Police Service chose to justify their stance by quoting Section 24(2) claiming that it was in the 'public interest' for them to refuse to 'confirm or deny in order to safeguard national security'.
It was been confirmed in a Select Committee investigation that the undercover police unit known as the National Extremism Tactical Coordination Unit (NETCU) attended and gave Powerpoint presentations to meetings of the Consulting Association blacklisting organisation. The MPS letter identifies the guidance on this issue as follows:
'IF ASKED: is it true that NETCU shared information with the Consulting Association?
We do not discuss matters of intelligence'.
Supt Steve Pearl, who ran NECTU, is now a director at Agenda Security Services, which provides employment vetting services. His former boss, ex-Assistant chief Constable Anton Setchell was the senior police officer in charge of the entire UK police’s domestic extremism machinery between 2004 and 2010 is currently head of global security at Laing O’Rourke – one of the construction companies which was a Consulting Association member.
 
The Police are under no legal obligation to adopt a NCND defence, as the Freedom of Information Act allows for statement confirming or denying for public interest reasons, where it may:
'inform issues that are currently the subject of public debate in relation to government surveillance and improve the quality and accuracy of public debate, which may otherwise be steeped in rumour and speculation'

Given the huge public interest in the undercover police surveillance of women activists deliberately targeted by officers from the Special Demonstration Squad and other secret political police units, it seems a difficult decision to justify. The NCND defence adopted by the MPS in relation to the women activists was defeated in the High Court in September. Some of the women activists currently suing the Metropolitan Police themselves appear on the Consulting Association blacklist.

The Met. Police Service letter admits:
'legitimate public interest in informing public debate in relation to issues surrounding surveillance tactics' and notes that 'the Blacklist Support Group and the wider issues regarding the practice of blacklisting'  but still adopted a NCND stance.
A number of blacklist activists, including Blacklist Support Group secretary Dave Smith have been refused copies of their own personal police files made under Subject Access Requests on the basis that providing the documents may jeopardise ongoing criminal investigations.
Smith responded to the latest Met Police statement:
'It is without doubt that the police and security services are spying on trade unionists fighting for justice on the issue of blacklisting.  They have colluded with big business to deliberately target trade unionism over decades. Shrewsbury, Orgreave, Blacklisting; the list goes on and on.  The refusal to provide any information whatsoever smacks of an establishment cover-up.  Blacklisting is no longer an industrial relations issue: it is a human rights conspiracy.' 
Lawyers working for the Blacklist Support Group have submitted a complaint to the Internal Police Complaints Council about the role of the police in blacklisting. Despite accusations of an establishment cover-up, even the police were forced to admit the flow of information was not purely one way.

'While correspondence from the police in relation to this complaint continually raises concerns about the quality of their investigation, it is interesting to note that they confirm that they have identified a potential “flow of information between Special Branch and the construction industry'.
