Call for Probe into Union Collusion in Blacklisting

WE THE undersigned, are writing this open letter in the spirit of fraternal debate among members of the newly merged Ucatt / Unite construction union.
The upsurge in industrial militancy in the last few years demonstrates that when the official union works alongside rank and file activists, it is possible to mobilise workers even in a hostile environment. The merger offers an opportunity to start anew the fight against the appallingly high fatality rates and casualisation of the construction industry by combining the best traditions of the two unions.

However, one issue threatens to cause internal friction:  possible union collusion in blacklisting.

Some years ago, both Ucatt and Unite carried out internal investigations into possible union involvement in blacklisting.  But that was at a time when barely any of the documentation was available.

Since the High Court case, all that has changed.  The employers were forced to provide witness statements and disclose 40 years’ worth of documentary evidence. It is now in the public domain that officials in both unions were recorded as the source of information on Economic League and Consulting Association blacklist files.  Some of those named, remain senior officials in Unite and Ucatt to this day.  Every union activist in construction knows who the named officials are, as does every major employer.

The leadership of both unions have now seen the evidence: discussions about those officials potentially implicated in blacklisting or with overly cosy relationships with industrial relations managers has been part of the behind the scenes discussions in the run-up to the merger.

The High Court litigation won a multimillion-pound settlement for blacklisted workers.  We fully acknowledge and recognise the tremendous legal, political and industrial campaigns that the unions have undertaken.

But compensation is not the same as justice.  No-one has been held accountable for their actions.   We remain resolute in calling for a public inquiry into blacklisting.  But that is for a future Corbyn government.  Now is the time to put our own house in order.

We the undersigned call upon the new Unite construction section to engage an independent legal expert to carry out a thorough investigation of the allegations relating to union collusion in blacklisting, with a remit drawn up in conjunction with the blacklisted workers.   If the implicated officials are completely innocent, then this is their opportunity to clear their name once and for all.  But if the independent investigation concludes that there is a case to answer, then the union should take the appropriate disciplinary action.  We are not looking for a witch-hunt, we simply want answers into possible union collusion in order to avoid repeating mistakes of the past.

This issue has haunted the union for years and until it is prepared to act, it will continue to be a running sore that hinders building unity in the newly merged union.  We need to unite in order to fight against unscrupulous employers and the Tories, but the newly merged union needs to start with a clean slate.

We urge members to please attend your branch or regional meetings, and send a motion in support of an independent investigation to the Unite EC.

Newcastle Rank & File Conference

LAST Saturday, the rank and file construction workers held their conference in Newcastle.  It was attended by some 80 workers in the British building trade from Scotland, Yorkshire, Liverpool, Manchester and London, as well as Newcastle.  Topics under discussion included 'Umbrella Companies'; the JIB; the blacklist; and the by-election for the position on Unite's National Executive Council, a position left vacant by the surprise resignation of John Sheridan.  Media representatives from Channel Four's Dispatches program were present and conducted interviews after the conference.   

Tameside TUC's book 'Boys on the Blacklist' was promoted and supported by many of the electricians and building workers present.  Concern was expressed by the delegate from Tameside TUC about revelations that Pluto Press, the intended publishers of the forthcoming book about blacklist by the journalist, Phil Chamberlain and the activist Dave Smith, had indicated that they were no longer willing to publish it.  This came as the Tameside TUC delegate to the conference told of a secret e-mail from a senior Unite official to the Unite legal department, in which it was stated that 'Boys on the Blacklist' had 'material in it that had not been approved (by Unite)' and effectively dismissing the book as an 'amatuer effort'.   

We were told well over a month ago by sources close to the Blacklist Support Group that at least one solicitor's letter had been sent to threaten the forthcoming book on blacklisting.   If it turns out that both the employers and some trade senior union officers are trying to hinder publication and distribution of literature about the history of blacklisting in the British building trade it is a sad day for democracy in this country.   

Meanwhile, the Rank & File conference agreed to support the forthcoming strike action in November; to promote a campaign against Laing O'Rourke; and to back Frank Morris for the vacant position on the National Executive Council.

Blacklist News: January 2014

A few bits and pieces for early January:

1.  Blacklist Compensation Scheme Talks have been put on hold over the holiday break but an alternative set of proposals is being drawn up by lawyers for our side to present as an alternative to the employers scheme. We expect the blacklisting firms to go for a media splash to announce the scheme sometime soon but any compensation scheme drawn up exclusively by the blacklisting companies without the support of the blacklisted workers and the trade unions has no credibility whatsoever. In what other situation would a criminal be allowed to decide the compensation for the victims or the level of penalty for the crime they committed?

We advise any blacklisted workers to have nothing to do with the employers blacklist compensation scheme - even if you are only interseted in finacial compensation, the final offer will be considerably better than the human rights abusing companies are offering at the moment. The High Court case is due back in court in mid April 2014 - so is likely to focus the minds of the companies when it comes to the compensation scheme. Watch this space for more updates.

2. Blacklisting campaign honoured:
The year long Crossrail dispute for the reinstatement of blacklisted and sacked UNITE shop steward Frank Morris has been named by Red Pepper magazine as one of the Top Success Stories of 2013. Well done Frank Morris, Well done UNITE, Well done everyone who helped in the campaign from across the globe.We are in good company because the other successes were the Save Lewisham Hospital Campaign and the 3 Cosas. This recognistion goes alongside the other awards won by the Blacklist Support Group for our campaigning. BSG have also won a Robert Tressell Award at the Construction Safety Campaign AGM an Alan Award for campaigners of the year at Hazards National Conference and were nominated and short-listed for human rights camapign of the year at the Liberty Awards. The awards are recognition for all the hard work put in by supporters across the country - thank you all very much - please give yourself a big pat on the back. 3. Alder Hey Hospital, Liverpool:
Blacklist Support Group protest Laing O'Rourke site at Alder Hey Hospital, East Prescot Road, Liverpool 8.00am Saturday, January 18th. Laing O'Rourke are one of the leading blacklisting companies, are a defendant in the High Curt and are currently refusing trade union recognition on the project. Crown House (Laing O'Rourke's M&E subsidiary) left the JIB in 2012 and are the only major electrical company in the UK refusing to work under nationally agreed terms and conditions. If you are in the NW region - please spread the word & join the NW Rank & File and the Blacklist Support Group for a big turn out.

4. Campaign Opposing Police Surveillance:
Blacklist Support Group is working alongside the family of Stephen Lawrence, the female activists sexually abused by undercover police, environmental and anti-racism campaigners calling for a full public inquiry into the role of police spies in subverting democratic legal protest movements. 5. News from America:
The US version of the HSE has just levied a massive fine on a US company for blacklisting a trucker who took firm to court after an accident. Why isn't the HSE taking legal action against British construction firms who blacklisted workers raising safety concerns and union safety reps? Police watchdog says Special Branch colluded in blacklisting!

We are publishing in full the latest mailing for the Blacklist Support Group.


1. Blacklist Compensation Scheme

No compensation scheme can be signed off without the agreement of blacklisted workers. And our only concern is to get the best possible settlement for blacklisted workers and fight to fully expose the conspiracy. Without our agreement, there will be no deal. And BSG will not agree to anything without fully consulting every blacklisted worker involved with the campaign. Despite announcing the proposals in the press, no-one from the compensation scheme has so far contacted the Blacklist Support Group to discuss the issue but we will be part of the talks soon enough. From the discussions that have taken place, the following items have been raised:
  • Every individual on the blacklist should be compensated regardless of dates or circumstances
  • If a blacklisted worker has died - then their widows or children should be entitled to compensation
  • No gagging clause - we still want a public inquiry
  • A matrix should be used to calculate compensation based upon multiple factors (rather than a schedule of financial loss, which is virtually impossible to calculate over so many years)
  • Guaranteed jobs for blacklisted workers on major projects
This is our starting point. If after negotiations, no deal is good enough, then we will be going back to the High Court.

Glenda Jackson MP managed to secure an adjournment debate and got one and a half hours debate on the floor of the House of Commons. Multiple calls for a public inquiry. Conservative Stephen McPartland MP said he will help set up a cross party group of MPs on the issue.



4. Crossrail Blacklist Victory Party
That's the way to celebrate a victory. Absolute banging night out. People came from as far away as USA, Scotland, Wales, Liverpool, Manchester to have a dance and raise a glass to Frank Morris.
