Blacklisting dispute averted on Crossrail

THE threat of industrial action on Crossrail was averted after Unite members secured the reinstatement of an electrician suspected of having faced fresh blacklisting. 

Workers had raised fears over the dismissal in late February 2019 of Martin Overy, a former Unite safety representative, who was sacked almost immediately after getting a job at London’s Paddington station (Risks 887).  Mr Overy, whose name was included on the Consulting Association’s blacklist, was sacked five hours after signing a contract with Site Operative Solutions Limited.  In 2016 he received compensation for having been blacklisted, but has struggled to find work since. The union-backed Blacklist Support Group was concerned that Skanska, the company that controls Paddington, may have sought to get rid of him.  However, following a March meeting with Unite official Guy Langston, Mr Overy was reinstated.  In 2016, Skanska was compelled to formally apologise for its role in blacklisting workers. 

Blacklist Support Group joint secretary and Unite executive council member Roy Bentham said:  'This demonstrates that this union can defend its blacklisted members.  In an industry with such an appalling fatality record, workers who are prepared to raise concerns about safety should be valued.  But instead, the treatment of Martin Overy seems a blatant case of blacklisting.'
He added:  'The willingness of the rank and file to take action was never in question, and was central to Martin’s reinstatement.'

Blacklist Group report on Big Ben contract

MPs lined up to call for a public inquiry into blacklisting and for Sir Robert McAlpine to be stripped of the contract to refurbish Big Ben during a parliamentary debate earlier today (Tues 5th September).

 Blacklisting company Sir Robert McAlpine have already been paid £3.5m of public money to carry out the enabling works on Big Ben and are in line for another bumper £29m pay-out to complete the 4 year refurbishment project.
The human rights of over 3000 construction workers were breached when they were repeatedly denied work simply for their trade union membership. MPs questioned whether Sir Robert McAlpine Ltd, as the driving force behind the
blacklist, was the right contractor to be carrying out the works on Big Ben: the symbol of British democratic values.

 Shadow minister for labour, Jack Dromey said: "there has to be consequences for historic blacklisting" adding that "it is a scandal that the iconic Big Ben contract has been given to that company' [Sir Robert McAlpine]

 The SNP employment spokesperson, Chris Stephens MP said:  
'Blacklisting firms have grown rich on public sector contracts' arguing that is was an 'act of bad faith by the government that the one of the main perpetrators is being given access to public money'

 The call for Sir Robert McAlpine to be stripped of the Big Ben contract was repeated by numerous MPs including Chuka Ummuna throughout the packed Westminster Hall debate.

 During the debate, Chuka Ummuna presented previously unreported evidence gathered from FOI requests that show emails between Crossrail and contractors on the publicly funded project that showed continuing surveillance of union members.  Ummuna described the new evidence as 'ugly underbelly of this sector that continues to go unaddressed' and repeated the call for a full public inquiry to finally get the truth behind this hidden human rights conspiracy.

 Conservative minister Margot James flailed in her attempted defence of the government’s inaction, claiming that the 'government take the issue of blacklisting very seriously' but point blankly refused to answer direct questions about the controversial Big Ben contract from Chuka Ummuna, Chris Stephens and Jack Dromey.

The blacklisting conspiracy is linked to the undercover police scandal as senior officers from police units engaged in spying on so-called ‘domestic extremists’ attended and gave a PowerPoint presentation at one of the meetings of the illegal Consulting Association.  Chuka Ummuna said:  that documents 'strongly suggests that some of the evidence was supplied with the collusion of the police or the security services.'

Vic Williams blacklisted electrician from Leytonstone in east London said:
'12 months ago, the big construction companies gave us an apology for their involvement in blacklisting.  They were only sorry for getting caught.  McAlpine are coining in taxpayers money, they’re laughing at us. If MPs had any moral compass, they’d strip McAlpine of the Big Ben contract.'

Dave Smith, blacklisted construction worker and secretary of the Blacklist Support Group commented:
'In all the media coverage of the Houses of parliament construction works, Big Ben was described as the symbol of British democratic values. So how can a company that breached the human rights of thousands of honest construction workers be a suitable contractor for one of the most prestigious construction projects in the world? The iconic bell of Big Ben might have fallen silent but blacklisted workers refuse to remain silent until those guilty of orchestrating this national scandal are forced to account for their actions at a public inquiry.'

Sir Robert McAlpine Limited is also a major financial donor to the Conservative Party.

Blacklister Balfour Beatty Slogan: 'Build to Last'

Confronting Trump & 'Lucrative Eyesores' in Future Pricing
AS environmental and other campaigners tool-up for action against the potential landscape contracts that the accused blacklist company Balfour Beatty are eyeing up, those who calculate the political risks in pricing projects will have to have their wits about them, but Donald Trump's proposed infrastructure projects may help.
This at least is the view of Matthew Vincent's Lombard column in the Financial Times yesterday.  He writes that:  'Balfour Beatty will either have to price that risk perfectly -or leave it with customers.'  And he adds:  'Neither task, as pollsters will attest, will be easy.'
It seems that among the potential 'landmark contracts' deemed to be landscape blots by political campaigners are, according to Mr. Vincent, include 'the HS2 rail link, the Hinkley Point C nuclear power station, and a potash mine on the North York Moors national park.'
Interestingly, it seems, that these days Balfour makes nearly half of its revenue from the USA, and has even been linked - erroneously, it claims - with the woeful concept which is President Trump's Mexican border wall.
Meanwhile, on the same page of the same issue of FT,  Gill Plimmer in an article titled 'Balfour Beatty ready to seize Trump chances' writes:
'Balfour Beatty has returned to profit after a torrid two years and is poised to take advantage of Donald Trump's plege to boost infrastructure spending.'
But for shareholders at least the fascination of Balfour's in all those lucrative eyesores has brought about a much needed return to 'disciplined bidding and risk pricing'.
In Britain, Balfours generates £1.9bn in construction revenues, including work building London's Crossrail train  facility.

Balfour Beatty Bosses Sacked on Crossrail

NEWS of the sacking by Balfour Beatty of the Project Director,  a Deputy Director and an industrial relation's consultant on Woolwich Crossrail, comes as CONSTRUCTION News reports today that:

'Balfour Beatty has seen off competition from Laing O'Rourke, Morgan Sindall and Vinci to land a £70m contract to complete and fit-out the new Crossrail station at Woolwich.'


Now work will start this month and complete in 2018 when Crossrail is due to fully open for service.
Balfour Beatty’s UK Construction chief executive Nicholas Pollard, said: 'Our experienced major project team’s ability to deliver high profile infrastructure schemes has been recognised with this award of the final Crossrail station package for Europe’s largest construction project. Our use of innovative computer-aided building information modelling tools, linked to off-site construction, will reduce the overall works programme compared to traditional construction methods.'
Sources close to the workers say that Gerry Harvey has asked the Unite union for talks to move the project forwardforward. 
The building site workers are demanding that all negotiations that take place must have an elected Unite Convenor and Woolwich shop stewards present. 
In December last year the Daily Mirror reported on another Crossrail project thus:
'Workers building Crossrail are ‘exhausted physically and mentally’, according to internal company documents seen by the Mirror.  They are having to walk through two miles of tunnels to take a toilet break and wasting two hours a day as a result, company emails reveal.'

Select Committee on Compensation Con!

1. Select Committee publishes final damning report into blacklisting
The Scottish Affairs Select Committee have published a final report that is absolutely damning of the construction firms involved in blacklisting and their compensation scheme. BSG wish to put on record once again our genuine appreciation for the tremendous work Ian Davidson and all the other MPs on the committee have carried out on behalf of blacklisted workers over the past 3 years.
2. Public Inquiry - Blacklisting / Undercover police
During the debate in House of Commons about police spying on MPs & activists, Home Office Minister Mike Penning confirmed the whistleblowers would be exempted from Official Secrets Act if they give evidence at #spycops public inquiry. This is a massive step forward and hopefully will spur on Peter Francis and other police whistleblowers to come forward.
3. Crossrail sackings & arrests
Protests on Crossrail have been temporarily suspended to allow a window for negotiations between UNITE and the Skanska- Costain joint venture.
Dave Smith was in Court today. The full trial is set for July 23rd at City of London Magistrates Court.

Blacklist Support Group Official Bi-AGM Report

THE Blacklist Support Group bi-annual general meeting took place in Glasgow on Saturday 7th March 2015, chaired by Roy Bentham.  Below is a summary of the main topics discussed:
1. The meeting opened with a minutes silence for blacklisted scaffolder and Shrewsbury campaigner Mick Abbott and other comrades who have passed away recently.
 
2. Treasurer's Report was presented by Steve Kelly and agreed by the meeting. Two new auditors were elected.
The meeting passed a message of thanks to all those individuals, union branches and organisations who have financially supported the campaign.  Without your support the BSG would be unable to operate.
 
3. Secretary's Report was presented by Dave Smith
Six years of campaigning led by blacklisted workers themselves has resulted in a situation where a public inquiry into the national scandal is nearly within reach. We have been campaigning for this non-stop and everyone involved should be proud of what we have achieved so far.  The publication of the 'Blacklisted' book at this time, is a conscious attempt to make blacklisting and surveillance by corporations and the police part of the General Election debate.  The media coverage about undercover police spying on trade unions generated by the book has already caused waves. The book is very much a team effort by all those involved in the Blacklist Support Group - investigative journalists, trade unions, lawyers, politicians, social justice campaigners but mostly blacklisted construction workers.  We thank you all.
The official book launch is not until Thursday 12th March in parliament - but the first people to see copies were the blacklisted workers at the BSG meeting.  A copy of 'Blacklisted' was presented to George Tapp, for his services to the campaign.  George was attending the meeting on crutches after he both his knee caps were fractured after he was dragged 100 yards down the road by a vehicle in Manchester during a protest against blacklisting.  George told the meeting that he was still suffering complications because of his head trauma.
4. Election of Committee
Brian Higgins, the Northampton based bricklayer with the largest blacklist file in the country had decided to stand down from the BSG committee but passed on his message of support.  The meeting gave Brian an ovation for the hard work he has carried out in the fight against blacklisting for over 30 years, from the Laing's Lock Out Committee to the tireless work in getting the issue raised in Europe and for his period on the national committee of the BSG.

5. Guest Speaker - Ian Davidson MP
Ian Davidson MP, chair of the Select Committee investigation into blacklisting praised the campaigning work of the BSG and said he supports the call for a full public inquiry into blacklisting as the only way of exposing the full extent of the conspiracy.  He told the meeting that there will be a new report published before the General Election.  The Select Committee has been provided with a vast amount of new documentation relating to blacklisting that is not currently in the public domain. This will be placed on the parliament website for all to see before the Election.
The BSG gave Davidson an ovation and want to put on record our sincere gratitude for the magnificent work that he has undertaken in parliament on behalf of blacklisted workers.  The Select Committee investigation has brought blacklisting into the political mainstream and his role as chair was crucial in moving the story forward. The blacklisted workers present genuinely appreciate his efforts.
 
6. Crossrail
Guest speaker Helen Clifford - from Leigh Day solicitors told the meeting about the Crossrail safety issues highlighted by the narrative verdict in the Corners Court inquest into the death of Rene Tkacik on Crossrail.  A whistleblower has exposed the climate of fear on the project, where workers are worried of losing their job if they complain about safety issues but this evidence was not allowed in the inquest.  The meeting endorsed the statement from London Hazards Centre
Dan Collins - a UNITE union member from London has been sacked from Crossrail after he raised safety concerns. Originally the Costain - Skanska joint venture agreed that he should be reinstated but the two blacklisting companies have both reneged on their promise.
The BSG AGM and the construction rank & file unanimously agreed to launch a national campaign to get Dan Collins reinstated on Crossrail and improve safety on the project by allowing proper involvement of the workers.  We appeal to all our supporters to identify Crossrail, Costain & Skanska projects across the UK and organise local direct action protests.  Flyer for us in the campaign is attached. Construction News report: Crossrail Death

A Slovakian engineer who was killed working on Crossrail may have been vulnerable because of his limited English and fellow workers’ impatience, a coroner heard today.
René Tkacik was was killed while spraying concrete 32ft below Fisher Street, Holborn, for the Bam Ferrovial Kier joint venture on last year.

At an inquest into his death at St Pancras Coroner’s Court, Mr Tkacik’s widow Renata described her husband as a 'highly experienced' sprayer who was left unsure what to do because of his 'rudimentary' English.  She claimed Mr Tkacik took a dictionary to work but colleagues were rude to him because of communication problems.  Mrs Tkacik said her husband had a 'difficult living condition' in the accommodation provided for him by his employers.

'He didn’t sleep properly and was constantly tired,' she told the court and 'his English was rudimentary and he complained to me that when he went to work he didn’t know what to do.  He always had a dictionary with him, but even that was not enough.'

She added that Mr Tkacik’s colleagues had little time for him because of his limited English, and were often 'rude'.

Demonstrators from trade unions Unite, Ucatt and GMB protested outside the court this morning, calling for the unionisation of the £15bn Crossrail project.  Placards displayed outside the court read 'No more site deaths' and 'People before profit'.  Mr Tkacik was crushed to death by a concrete slab while working in the tunnel in the early hours of 7 March 2014.

The 44-year-old was pronounced dead at 6.14am by doctors who took six minutes to get to him in the tunnel.

Mr Tkacik was left with “devastating injuries entirely incompatible with life,” and would have died instantaneously, the court heard.

His death was recorded as blunt force trauma to the head and chest.

Mrs Tkacik described her husband as a teetotaller with an eye for detail.  A toxicology report following his death showed no signs of alcohol, caffeine, or drugs in Mr Tkacik’s system.

Mrs Tkacik said he was a ‘highly qualified’ sprayer and blaster who had worked on various jobs, including tunnelling work.

When Mr Tkacik first joined Crossrail as a sprayer he passed four examinations, all set in English.
A Crossrail spokesperson said:
'Everyone who works on Crossrail was affected by this terrible incident.  Our thoughts and sympathies are with RenéTkacik’s family and colleagues.  Crossrail has a good safety record and sets the most stringent contractor safety requirements in the industry. Safety has always been, and continues to be, the number one value for Crossrail and critical to the success of the programme.  There is nothing so important on Crossrail that it cannot be done safely. This terrible incident only increased that resolve.'

1. BLACKLIST Support Group statement:
It is six years since the construction industry blacklist was discovered. Since then there have been new laws introduced, Select Committee investigations and a historic 12 months industrial dispute on Crossrail to reinstate a blacklisted union activist. The involvement of the police and security services in blacklisting of union activists is now proven beyond doubt and has been raised in parliament by John McDonnell MP.
The High Court (Fri 13 Feb) and the Court of Appeal (4-5 Feb) hearings on blacklisting in the past week have seen the glacially slow British legal system inching nearer to a conclusion.
Yet in this week has also seen the release of a report about victimisation and blacklisting of whistleblowers in the NHS and the sacking of another union activist on Crossrail who dared to raise concerns about safety issues on the site. The coroners hearing into the death of Rene Tkacik, killed on the Crossrail project starts next week.
Far from being a thing of the past, blacklisting is endemic across British industry, from the NHS, banking, hotels, offshore oil & gas and of course construction. The fight is ongoing wherever working people are prepared to take a stand against corporate greed. Yet David Cameron, Teresa May and Vince Cable have refused to take actio. The need for a fully independent public inquiry into the national scandal has never been greater.
 
2. Very positive outcome in High Court blacklisting group litigation on Friday 13th Feb.
Lord Justice Supperstone told the hearing that the full trial will take place around Easter 2016.
Currently 385 claimants against 37 companies. There are another 187 claims waiting to be submitted - this number is likely to rise even more. The final cut off date for anyone blacklisted to be added to the litigation is 2nd November 2015. The average claim for loss of earnings is currently £110,000 per claimant. This is without any potential damages for defamation, hurt to feelings or compensation for human rights violations that claimants may receive.
The lawyers are now drawing up a list of 25 potential test cases. If both sides cannot agree the names, the judge will determine which cases will be heard.
 
The judge commented that the lawyers representing the claimants have been speaking with one voice but the employers were divided (and should sort their act out).
 
The judge made a number of orders about the dates that paperwork needed to be submitted to the court.
 
The legal costs in the case by December 2014 had already reached in excess of £10 million. 
The next hearing will be 14th May.
The Blacklist Support Group wish to put on record our admiration for the colossal amount of work being carried out by the lawyers involved in this groundbreaking legal case.

A unite activist was sacked from the crossrail project at Bond Street today. The electrician was sacked for raising legimate health and safety concerns. The contractor is Skanska / Costain joint venture and he was working for VGC through an agency. VGC are non JIB company and non compliant (JIB is the national agreement for electrical contracting which is supposed to apply on the Crossrail project).
Our demands are simple - reinstate the sacked worker and for VGC to be removed fron the project. Yet again Crossrail management seem to be oblivious to the workers health and safety concerns this has to stop. The inquest into the death of Rene Tkacik who was killed on Crossrail starts at St Pancras Coroners Court on Monday 23rd February.
Unite were in negotiations today but nothing came off it. We must support our sacked brother.

Police watchdog says Special Branch colluded in blacklisting!

We are publishing in full the latest mailing for the Blacklist Support Group.


1. Blacklist Compensation Scheme

No compensation scheme can be signed off without the agreement of blacklisted workers. And our only concern is to get the best possible settlement for blacklisted workers and fight to fully expose the conspiracy. Without our agreement, there will be no deal. And BSG will not agree to anything without fully consulting every blacklisted worker involved with the campaign. Despite announcing the proposals in the press, no-one from the compensation scheme has so far contacted the Blacklist Support Group to discuss the issue but we will be part of the talks soon enough. From the discussions that have taken place, the following items have been raised:
  • Every individual on the blacklist should be compensated regardless of dates or circumstances
  • If a blacklisted worker has died - then their widows or children should be entitled to compensation
  • No gagging clause - we still want a public inquiry
  • A matrix should be used to calculate compensation based upon multiple factors (rather than a schedule of financial loss, which is virtually impossible to calculate over so many years)
  • Guaranteed jobs for blacklisted workers on major projects
This is our starting point. If after negotiations, no deal is good enough, then we will be going back to the High Court.

Glenda Jackson MP managed to secure an adjournment debate and got one and a half hours debate on the floor of the House of Commons. Multiple calls for a public inquiry. Conservative Stephen McPartland MP said he will help set up a cross party group of MPs on the issue.
